Policies, Terms & Conditions, and Refund Policy

These policies govern all notary services provided by CandaceJ Notary, a mobile notary and Remote Online Notarization (RON) service operated by Candace Jones, a Texas-commissioned Notary Public, doing business as CandaceJ Co. By booking an appointment or using any service provided by CandaceJ Notary, you agree to the following terms.
SECTION 1 — SERVICE POLICIES
1.1 Scope of Services
CandaceJ Notary provides the following services:

Mobile notarization — acknowledgments, jurats, oaths, affirmations, and copy certifications

Loan signing agent services for real estate transactions

Remote Online Notarization (RON) via secure video session

Apostille preparation and submission assistance
CandaceJ Notary does not provide legal advice, legal document preparation, or any service that constitutes the practice of law. Clients are encouraged to consult a licensed attorney for legal guidance.
1.2 Appointment Scheduling

All appointments must be scheduled in advance through the client portal at clientportal.candacejco.com or via direct contact at info@candacejco.com.

Appointment confirmation will be sent via email within 24 hours of submission.

Same-day appointments are available based on calendar availability and are subject to a rush fee.

CandaceJ Notary reserves the right to decline any appointment request at its sole discretion.

1.3 Identity Verification Requirements
All signers must present a valid, unexpired government-issued photo ID at the time of notarization. Accepted forms of identification include:

Texas Driver's License or State ID

U.S. Passport or Passport Card

U.S. Military ID
-
Permanent Resident Card (Green Card)

Tribal ID (where applicable)
Expired identification cannot be accepted under any circumstances. If a signer cannot produce acceptable identification, the notarization cannot be performed and the appointment fee may still apply.
1.4 Document Requirements

Documents must be complete with no intentionally blank spaces before the appointment.

Signers must not pre-sign documents requiring notarization — all signatures must be witnessed at the time of the notarial act.

All signers listed on a document must be physically present (in-person) or present via live video session (RON).

CandaceJ Notary is not responsible for errors in document content. Clients are responsible for ensuring documents are accurate and complete.

1.5 Right to Refuse Service
CandaceJ Notary reserves the right to refuse or discontinue a notarization at any time if:

A signer cannot be positively identified

A signer appears to be under duress, coerced, confused, or impaired

The document contains blank spaces that should be completed

The document appears fraudulent, altered, or incomplete
-
The notarization would violate Texas law or the notary's commission
In cases where service is refused after travel has occurred, the travel fee is still applicable.
SECTION 2 — FEES & PAYMENT
2.1 Fee Schedule
Fees are based on the current CandaceJ Notary fee schedule available at candacejnotary.com. All fees are governed by and do not exceed the maximum fees permitted under Texas Government Code Chapter 406:

In-person notarization: $10 per notarial act (signature)

Remote Online Notarization (RON): $25 per notarial act

Travel fees are separate from statutory notary fees and are disclosed prior to appointment confirmation

Add-on fees (scanbacks, rush, after-hours, weekend) are disclosed at time of booking
2.2 Fee Confirmation
All fees will be confirmed in writing via email before the appointment is finalized. By confirming your appointment, you agree to the disclosed fees. No additional fees will be charged beyond those confirmed without prior written notice.
2.3 Payment Methods
Payment is due at the time of service for individual clients. Accepted payment methods include:

Business Check (made payable to CandaceJ Co)

Credit or Debit Card (where available)
2.4 Business Account Billing
Signing services, title companies, law firms, and pre-approved business accounts may be invoiced per appointment. Payment terms are Net-15 or Net-30 as agreed upon in writing. Late payments beyond the agreed term may result in suspension of services and/or a late fee of $25 per invoice.
2.5 Returned Checks
Returned checks will incur a $35 returned check fee in addition to the original invoice amount. CandaceJ Notary reserves the right to require future payments by cash or electronic transfer for any client with a returned check history.
SECTION 3 — CANCELLATION & RESCHEDULING POLICY
3.1 Client Cancellations

Cancellations made at least 24 hours before the scheduled appointment will not be charged a cancellation fee.

Cancellations made less than 24 hours before the scheduled appointment are subject to a $25 rebooking fee.

Same-day cancellations after the notary has departed for the appointment are subject to the full travel fee plus a $25 cancellation fee.

3.2 No-Shows
If a signer is not present or not ready at the time of the scheduled appointment and the notary has arrived, the appointment will be considered a no-show. A second trip fee of $50 plus the applicable travel fee will be required before a new appointment is scheduled.
3.3 Rescheduling
Rescheduling requests made at least 24 hours in advance will be accommodated at no additional charge based on availability. Rescheduling requests made less than 24 hours in advance are subject to a $25 rebooking fee.
3.4 CandaceJ Notary Cancellations
In the rare event that CandaceJ Notary must cancel a confirmed appointment, clients will be notified as soon as possible and offered a full refund of any prepaid fees or a reschedule at no additional charge. CandaceJ Notary is not liable for consequential damages resulting from a necessary cancellation.
SECTION 4 — REFUND POLICY
4.1 General Refund Policy
Due to the nature of notary services — which involve the notary's time, travel, and professional preparation — refunds are limited. The following refund policy applies:

Full refund: If CandaceJ Notary cancels the appointment without client fault

Full refund: If the appointment cannot be completed due to an error by CandaceJ Notary (e.g., incorrect certificate type applied)

Partial refund: If the appointment is cancelled by the client at least 24 hours in advance and a deposit was collected — travel fee is non-refundable if travel was arranged

4.3 Non-Refundable Situations

Appointments where service was rendered — the notarial act was completed

Travel fees once the notary has departed for the appointment

Rush or same-day scheduling fees
-
RON sessions where identity verification (KBA) was completed and the session was initiated

Appointments where the client was unable to produce acceptable identification
-
Appointments where the document was incomplete or unsigned contrary to instructions
-
No-show appointments
4.4 Refund Process
To request a refund, contact CandaceJ Notary within 5 business days of the appointment at info@candacejco.com with your name, appointment date, and reason for the refund request. Approved refunds will be processed within 5–7 business days via the original payment method where possible.
4.5 Disputes
Any disputes regarding fees or refunds should first be directed to CandaceJ Notary via email at info@candacejco.com. CandaceJ Notary is committed to resolving disputes fairly and promptly. Chargebacks initiated without prior contact may result in termination of the client relationship and referral to collections for the disputed amount plus fees.
SECTION 5 — PRIVACY & CONFIDENTIALITY
5.1 Client Information
CandaceJ Notary collects only the information necessary to provide notary services, including name, contact information, identification details, and document information. This information is used solely for appointment management, service delivery, and legal record-keeping.
5.2 Notary Journal
As required by Texas law, CandaceJ Notary maintains a notary journal containing records of all notarial acts. This journal is a legal record and may be subpoenaed by a court of law. Journal records are kept confidential and are not shared with third parties except as required by law.
5.3 RON Session Recordings
Remote Online Notarization sessions are recorded and archived as required by Texas Senate Bill 2128. Recordings are retained for a minimum of 5 years. Recordings are stored securely and are only accessible to CandaceJ Notary and authorized parties as required by applicable law.
5.4 No Sale of Information
CandaceJ Notary does not sell, rent, or share client information with third parties for marketing purposes. Client information is never used for any purpose other than the delivery of notary services and legally required record-keeping.
SECTION 6 — TERMS & CONDITIONS
6.1 Texas Law Compliance
All notarization services are performed in compliance with Texas Government Code Chapter 406, Texas Administrative Code, and applicable federal laws. CandaceJ Notary operates exclusively within the scope of authority granted by the Texas Secretary of State.
6.2 Limitation of Liability
CandaceJ Notary's liability is limited to the fees paid for the specific notarization service in question. CandaceJ Notary is not liable for any consequential, incidental, or indirect damages arising from the use of notary services, including but not limited to document rejection by third parties, delays in legal proceedings, or financial losses.
6.3 No Legal Advice
Nothing provided by CandaceJ Notary constitutes legal advice. CandaceJ Notary does not advise clients on the legal effect of documents, whether a document is appropriate for their situation, or what type of notarization is legally required. Clients should consult a licensed attorney for legal guidance.
6.4 Accuracy of Documents
CandaceJ Notary is not responsible for the accuracy, completeness, or legal validity of the contents of any document notarized. The notary's role is to verify the identity of the signer and witness the signing — not to verify the accuracy of the document's content.
6.5 Force Majeure
CandaceJ Notary is not liable for failure to perform services due to circumstances beyond its reasonable control including natural disasters, severe weather, illness, government orders, or other force majeure events. In such cases, appointments will be rescheduled at no additional charge.
6.6 Policy Updates
CandaceJ Notary reserves the right to update these policies at any time. Updated policies will be posted at candacejnotary.com with the effective date. Continued use of services after policy updates constitutes acceptance of the revised terms.
6.7 Governing Law
These policies are governed by the laws of the State of Texas. Any disputes arising from the use of CandaceJ Notary services shall be subject to the exclusive jurisdiction of the courts of Harris County, Texas.
